Michel IP Inn Discusses Patent Licensing at Roybal Courthouse

The first meeting of the new year for Judge Paul R. Michel Intellectual Property American Inn of Court was scheduled for January 23, 2014, in Room 1268 of the Edward R. Roybal Federal Courthouse at 255 East Temple Street, Los Angeles, California 90012.

The program entitled "Patent Licensing and Patent Misuse -- Spiderman's sticky web of patent and non-patent licensing," explores patent licensing issues and Kimble v. Marvel Enterprises, Inc. where The Ninth Circuit held that a license agreement with inseparable patent and non-patent rights that includes royalty payments beyond the patent’s expiration is unenforceable after expiration unless the agreement includes a discount rate for the non-patent rights. Kimble filed a petition for certiorari with the U.S. Supreme Court on December 13, 2013.
